Supreme Court, Stand on the Right Side of History & Strike Down the Muslim Ban

Washington, DC – The following is a statement from Farhana Khera, executive director of Muslim Advocates, following today’s Supreme Court oral arguments in Trump vs. State of Hawai’i – the lawsuit against President Trump’s long-promised, and unpopular, Muslim Ban:

“The stakes could not be greater for our nation: the Court should not allow the President of the United States to discriminate against a group of people based on their faith or risk repeating dark chapters in our nation’s history that we have later come to regret.

Almost 75 years ago, the government presented a nearly identical set of ‘proof-points’ for a similarly inhumane, unlawful argument – the mass internment of Japanese Americans – in the Supreme Court case Korematsu vs. United States. Justifications now known to be rooted in falsehoods and misrepresentations.

The Supreme Court, regrettably, ruled to support these discriminatory detentions that targeted Americans based solely on their ethnicity. We hope, for the sake of our nation, that the Supreme Court does not make the same mistake now.

The President and his administration’s tweets, propaganda, and balderdash must not distract the Court or the American public from the true purpose of the Muslim Ban: to circumvent the Constitution and ban Muslims from the United States.

Numerous lower courts have already declared that President Trump’s ban drips with anti-Muslim animus. Hopefully, the Supreme Court will reaffirm these rulings, stand on the right side of history, and declare once and for all that religious discrimination and bigotry have no place in our country.

Regardless of the Supreme Court’s final ruling, Muslim Advocates will continue to challenge the administration’s unjust and discriminatory policies until they are but one dark chapter in our nation’s history.”

Background information regarding Muslim Advocates work against the Muslim Ban:

Muslim Advocates has filed eight lawsuits against the Trump Administration regarding the Muslim Ban, including the first major lawsuit against Muslim Ban 3.0, Iranian Alliances Across Borders v. Trump, which resulted in a preliminary injunction against the ban.

The organization has also filed nine amicus briefs in various courts opposing the ban and multiple Freedom of Information Act requests to expose more information about how the ban was developed and is being implemented and recently released a report analyzing the effects and implications of the ban and the great lengths that the administration has taken to circumvent the Constitution.  New Muslim Advocates- Probolsky Research polling documents the unpopularity of the Ban among voters.

Muslim Advocates is a national legal advocacy and educational organization that works on the frontlines of civil rights to guarantee freedom and justice for Americans of all faiths.
